Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the ViralWave Studio application (the "Service") operated by us.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
1. Accounts
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
2. Social Media Account Connections
Our Service allows you to connect your social media accounts (Facebook, Threads, YouTube, TikTok, and others) to enable automated content posting. By connecting an account, you:
- Grant us permission to access and use your account information as necessary to provide the Service.
- Authorize us to post content on your behalf according to your instructions.
- Understand that we will store access tokens and related credentials securely to maintain the connection.
- Agree that you are solely responsible for all content posted through our Service to your connected accounts.
- Must ensure that all content posted complies with the respective platform's terms of service and community guidelines (e.g., YouTube's Community Guidelines, TikTok's Community Guidelines).
You may disconnect your social media accounts at any time through your account settings. Upon disconnection, we will revoke access tokens and remove stored credentials, though some data may be retained as required by law or for fraud prevention.
3. Use of AI Services
The Service provides access to artificial intelligence models to generate content. You are responsible for the prompts you provide and the content you generate. You agree not to use the Service to create any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Generated content is for your use, but we do not claim ownership of it. You are responsible for ensuring that your use of the generated content complies with all applicable laws and regulations, including copyright laws and platform-specific terms of service (e.g., Facebook, Threads, YouTube, TikTok).
4. Subscriptions and Payments
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle").
Payments are handled by our third-party payment processor, Stripe. By submitting your payment information, you grant us the right to provide the information to Stripe to facilitate the completion of your purchase.
Your first four preview posts are free and do not start a subscription. Paid access begins after checkout. Choose monthly billing or yearly billing at 20% below twelve monthly payments. Yearly plans are paid in advance once a year; content allowances renew monthly. The price, applicable taxes, and renewal details are shown in Stripe before you purchase.
You may cancel through the Stripe billing portal. Cancellation takes effect according to the date shown there.
Starter includes 15 posts with images and 3 optional replacements per content month, Pro includes 50 posts and 5 replacements, and Powerhouse includes 100 posts and 10 replacements. These allowances renew monthly with either billing frequency. AI caption editing does not consume the image replacement allowance. Unused generation and replacement allowances do not roll over.
You can change plans or billing frequency through Stripe. Stripe shows applicable prorated charges or credits before you confirm. A plan upgrade expands the current content allowance while preserving existing posts and review decisions. Changing billing frequency alone does not grant a duplicate content batch.
5. Content on Other Websites
Our Service may contain links to third-party web sites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.
6. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
7. Limitation Of Liability
In no event shall ViralWave Studio, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
